The University of Jordan Radio Meets Prof. Noman Al-Khatib from "Amman Arab University"

In a radio interview conducted by the University of Jordan Radio with Prof. Noman Al-Khatib, Professor of Constitutional and Administrative Law at the Faculty of Law at Amman Arab University, Dr. Al-Khatib A. explained, the government’s approach to the recommendation of His Majesty the King to stop the work of the Defense Law comes in appropriate circumstances, especially with the announcement of the World Health Organization The end of the situation and seriousness of the Covid 19 epidemic, and the recession of its impact on global health.

This is a discretionary authority for the executive authority, according to which it assesses the end of the seriousness of this epidemic on the one hand, and its impact on the safety and security of the homeland on the other hand. This historic decision represented by the royal will and the decision of the Council of Ministers is an act of sovereignty that by its nature cannot be challenged before any judicial authority.

Prof. Al-Khatib added that Jordan is a legal state in which the constitution is supreme, which is considered the constitutional basis for the issuance of Defense Law No. (13) of 1992, and its implementation on 03/17/2020, which granted the Prime Minister the power to take the necessary measures and procedures, including defense orders that can stop work. Any ordinary law with the aim of "securing the defense of the homeland and preserving the Jordanian state with its three pillars, the people, the territory, and the authority."

In response to the radio’s question, Dr. Al-Khatib replied that the aim of the defense orders issued by the Prime Minister is to protect the homeland and the citizen, and that stopping the implementation of some laws and restricting some freedoms was in the interest of the homeland and the citizen, while ensuring that there is a balance and proportionality with the public interest and the individual interest, without exaggeration. In restricting some freedoms and taking what is necessary to facilitate the life of the citizen as wanted by His Majesty the King

He added that with the issuance of the royal will to end the work (suspension of work) of the Defense Law, all the regular laws that were suspended in accordance with the defense orders will return, and constitutional legality will return with the associated gradation of legislation in force in the court, with the government’s commitment to take all measures that are commensurate with the decision to stop Defense law work.

As for the next stage, and in response to the radio’s question, Prof. Al-Khatib answered that the executive and legislative authority should work on preparing the necessary legislation that goes hand in hand with global developments, especially in the field of learning and higher education, and what is related to the research and educational process and its relationship to the technological progress that the world is witnessing.

At the end of the meeting, Prof. Al-Khatib wished that the Royal Decree would be issued to suspend the implementation of Defense Law No. (13) of 1992 and the Defense Order issued pursuant thereto, coinciding with the celebrations of the Kingdom and the Jordanian family on the occasion of the marriage of His Royal Highness, the Grand Crown Prince Al-Hussein bin Abdullah II, may God protect him.
